\u00b61. (C) During a November 24 meeting at his request, Chief
\nSecretary Madhav Ghimire told Charge that Prime Minister
\nNepal had not made a final decision to promote General Toran
\nJung Bahadur Singh to Lieutenant General, despite press
\nreports to the contrary. Post had previously expressed
\nconcern about the promotion of Singh (refs A-C), who is
\ncommanded the 10th Brigade at a time when one of its
\nbattalions allegedly committed serious human rights abuses,
\nincluding torture of detained Maoists in the Maharajgunj
\nBarracks and the alleged execution of 49 of the detainees in
\nthe Shiva Puri forest north of Kathmandu. <\/p>\n

Investigation Done; No Evidence Against Singh

\n\u00b62. (C) Ghimire claimed that a committee consisting of the
\nSecretaries from the Ministry of Home Affairs, the Ministry
\nof Defense, and the Prime Minister’s office had reviewed
\nSingh’s case and not found any evidence directly implicating
\nSingh in any crime or human rights abuse. No court cases had
\nbeen filed against Singh. Ghimire suggested that perhaps the
\norder to commit human rights abuses at Maharajgunj Barracks
\ncame “from the palace” or even the then-Chief of the Army
\nStaff, “bypasing Singh,” adding that sometimes commanders
\n“simply have to follow orders.” In this situation, it would
\nbe unfair to deny Singh the promotion. Should evidence later
\nemerge implicating Singh, then he could be prosecuted. <\/p>\n

Charge Outlines U.S. Concerns

\n\u00b63. (C) Charge said that any credible investigation of the
\nabuses committed at Maharajgunj Barracks must be complete and
\nassign proper responsibility. Charge noted that the
\npromotion of Singh would have a negative impact on the
\ncurrent government’s image and on the ability of the U.S. to
\ncooperate with the Nepal Army. The United States assigns
\ngreat importance to ending impunity for human rights abuses,
\nbe they attributed to the Nepal Army or Maoists. Any
\ndecision to promote Singh puts the interests of one
\nindividual career over that of the institution. <\/p>\n

\u00b64. (C) Ghimire thanked Charge for his honest assessment. The
\nPrime Minister values U.S. support and does not want to
\n“surprise” the United States. As the Prime Minister’s
\nForeign Policy Advisor, Rajan Bhattarai, suggested in late
\nOctober (ref C), Ghimire said the GON was preparing “four or
\nfive” criminal cases against the perpetrators of the most
\negregious human rights abuses, including the Maina Sunuwar
\ncase. Charge said progress on those cases would be welcome,
\nbut that the concerns about General Singh’s promotion would
\nnonetheless continue. <\/p>\n

\n\u00b65. (C) The Prime Minister is clearly under intense pressure
\nto promote Singh, including perhaps from New Delhi.
\nCarefully-planned military careers, including the ascension
\nof Major General Gaurav S.J.B. Rana (reportedly a close ally
\nof India) to Chief of the Army Staff, turn on the Singh
\npromotion. Post will continue to stress the negative
\nimplications of the Singh promotion on U.S.-Nepali military
\ncooperation and press for an independent, credible
\ninvestigation of the Maharajgunj incident.
