New Chief Justice Named

\u00b61. (SBU) On April 29, the Constitutional Council recommended
\nMin Bahadur Rayamajhee to be the new chief justice of Nepal,
\ncontinuing the tradition of seniority at the expense of the
\nMaoists’ preferred candidate. Rayamajhee was the most senior
\nof six Supreme Court justices eligible to replace Chief
\nJustice Kedar Prasad Giri, who on May 4 faces mandatory
\nretirement at age 65. Rayamajhee will reach mandatory
\nretirement age on December 12, 2009.<\/p>\n

Seniority Rules
\n—————<\/p>\n

\u00b62. (SBU) The selection of the new chief justice stalled for
\nseveral weeks while the seven-member Constitutional Council,
\nled by Prime Minister Pushpa Dahal, debated whether to uphold
\nthe tradition of seniority. Senior Maoist leaders, including
\nLaw Minister Dev Gurung — the only other Maoist on the
\nConstitutional Council — had publicly declared that the
\nchoice should be based on the caliber of the candidate. The
\nMaoists reportedly favored Justice Khil Raj Regmi.
\nRayamajhee will appear before the Parliamentary Special
\nHearing Committee, date to be determined, and then President
\nRam Baran Yadav will appoint him Chief Justice of the Supreme
\nCourt.<\/p>\n

Rayamajhee Biodata
\n——————<\/p>\n

\u00b63. (SBU) Described as bold and unbending in the media,
\nRayamajhee (also Rayamajhi) has a record of ruling against
\ngovernment actions, including scrapping the Royal Commission
\non Corruption and Control and overturning a ban on FM radio
\nnews broadcasts under the former king’s direct rule in
\nFebruary 2006. He has a reputation for commitment to
\ndemocracy and the rule of law, and he has never been
\nconnected to any allegations of corruption. His colleagues
\nhave criticized him for showing off and having a negative
\nattitude toward junior lawyers. Rayamajhee joined the
\nSupreme Court as an ad hoc justice in April 2001 after thirty
\nyears as a judge on various zonal and appellate courts,
\nincluding a stint as the chief justice of Hetauda Appellate
\nCourt. He became a permanent Supreme Court justice in
\nSeptember 2002. Rayamajhee was born on December 12, 1944 in
\nBhojpur, a district in the hilly region of eastern Nepal. He
\nholds a Bachelor’s degree in Law (1967) and a Master’s degree
\nin Political Science (1969) from Tribhuvan University,
\nKathmandu. He is married and has a son.<\/p>\n

\u00b64. (C) The Maoists’ push for a “merit-based selection” was a
\nthinly-veiled attempt to install a chief justice they
\nbelieved would be amenable to Maoist interests. Unlikely to
\nbow to political pressure, Rayamajhee could pose a challenge
\nto the Maoists — if, for example, they attempt to
\nunilaterally remove Chief of Army Staff Katawal.
\nNevertheless, given the controversy over the Maoists’ attempt
\nto sack Katawal (reftels), the Prime Minister may have wisely
\nchosen to bypass a battle over the Supreme Court Chief
\nJustice, since Rayamajhee will reach mandatory retirement age
\non December 12, 2009.
